Below are the terms and conditions (“Terms”) which are applicable to this website, any mobile application (collectively, “the Service” or “the Site”) as well as any feature or service offered by the Casino Comp Wallet. You agree that (i) you are able to create a binding legal obligation; (ii) you are not barred from receiving deals from partner casinos and those affiliated with Casino Comp Wallet; (iii) your use of our Services will at all times comply with these Terms of Service; (iv) you will only redeem and claim deals under your legal name; (v) you have the right to provide any and all information you submit to the Site or the mobile application, and all such information is accurate, true, current and complete and (vi) you will update and correct any information you submit to the Site or the mobile application.
You acknowledge and agree that your use of our Services must also be in accordance with the usage rules established by your mobile device platform or provider.
If you do not wish to be bound by these terms, you may access or use Our Services.
If at any time you do not agree to any portion of the Terms, your permission to use the Services shall immediately terminate and you must immediately stop using the Services.
Access to Services
Casino Comp Wallet retains the right, at our sole direction, to deny service or use of the Service or an account to anyone at any time for any reason. While we use reasonable efforts to keep our Services accessible, the mobile application, site, and/or your account may be unavailable from time to time. You should understand that there may be interruptions in service or events, Service access, or access to your account due to circumstances both within our control (e.g., routine maintenance) and outside of our control.
Password Security
You are responsible for maintaining the confidentiality of your Login Credentials and are solely responsible for all activities that occur using your Login Credentials. Your account in non-transferrable. You cannot sell, combine or otherwise share it with any third party. You agree not to allow a third party to use your Login Credentials at any time. We reserve the right to terminate any username and password, which we reasonably determine may have been used by an unauthorized third party. You agree to provide true, accurate, current, and complete Login Credentials. Casino Comp Wallet may, in its sole discretion, remove Your information from the Sites, warn Casino Comp Wallet’s community of Your actions, issue a warning, suspend or terminate Your account and any current activities at the Sites immediately, without notice to You, and refuse to provide our Services to You if You breach these Terms of Service, or if We are unable to verify or authenticate any information that You provide to Us, or if we believe Your actions may cause financial loss or legal liability for You, Casino Comp Wallet’s affiliations and partners, or Us. Casino Comp Wallet reserves the right, in its sole discretion, and for any reason, to refuse access to any user at any time to those portions of the Sites that require registration. You agree that Casino Comp Wallet shall not be liable to You or any third party for any termination of Your access to any material, content and deals provided by the Service.
Dispute Resolution: Arbitration
Please read this carefully. It affects your rights.
- You agree that by using this service, you and Casino Comp Wallet are each waiving the right to a court or jury trial or to participate in a class action. You and Casino Comp Wallet agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, representative, or collective proceeding. Any arbitration will take place on an individual bases; class arbitrations and class actions are not permitted.
- You and Casino Comp Wallet agree that any and all claims and disputes arising from or relating in any way to the subject of matter of these Terms, your use of the Service, or your and Casino Comp Wallet’s dealing with one another shall be finally settled and resolved through Binding Individual Arbitration as described in this section. This agreement to arbitrate is intended to be interpreted broadly. The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes of the American Arbitration Association (“AAA”), as modified by this section. The arbitration will be conducted using one arbitrator who is mutually agreed upon by both Parties and who has substantial experience in resolving commercial contract disputes, who shall be selected from the appropriate list of AAA arbitrators in accordance with the Arbitration Rules and Procedures of AAA. For any claim where the total amount of the award sought is $10,000 or less, the arbitrator, you, and Casino Comp Wallet must abide by following rules (i) the arbitration shall be conducted solely based on telephone or online appearances and/or written submissions; and (ii) the arbitration shall not involve any person appearance by the parties or witnesses unless otherwise mutually agreed by the parties. If the claim exceeds $10,000, the right to a hearing will be determined by the AAA rules, and the hearing (if any) must take place in New York, NY. The arbitrator’s ruling is binding and may be entered as a judgement in any court of competent jurisdiction, or application may be made to such court for judicial acceptance of any award and an order of enforcement, as the case may be.
- There is no judge or jury in arbitration. Arbitration procedures are simpler and more limited than rules applicable in court and review by a court is limited. Neither you or Casino Comp Wallet will be able to have a court or jury trial or participate in a class action or class arbitration. You and Casino Comp Wallet each understand and agree that by agreeing to resolve any dispute through individual arbitration, YOU AND Casino Comp Wallet ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ANY DISPUTE SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator may not consolidate the claims of multiple parties.
Waiver
No waiver by either you or Casino Comp Wallet of any breach or default or failure to exercise any right allowed under these Terms of Service is a waiver of any preceding or subsequent breach or default or a waiver or forfeiture of any similar or future rights under our Terms of Service. The section headings used herein are for convenience only and shall be of no legal force or effect. If a court of competent jurisdiction holds any provision of our Terms of Service invalid, such invalidity shall not affect the enforceability of any other provisions contained in these Terms of Service, and the remaining portions of our Terms of Service shall continue in full force and effect.
Disclaimer of Warranties
- YOU EXPRESSLY AGREE THAT USE OF THE SITES AND THE SERVICES IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM Casino Comp Wallet OR THROUGH THE SITES OR THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
- Casino Comp Wallet MAKES NO WARRANTY THAT THE SERVICES OR ANY CONTENT PROVIDED THROUGH THE SITES OR ANY CONTENT CONTAINED THEREIN OR DOWNLOADED THEREFROM WILL MEET YOUR REQUIREMENTS, BE ACCURATE, COMPLETE, CURRENT OR TIMELY, OR THAT THE SITES OR THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE. IN THE EVENT THAT WEB SITE CONTENT IS INACCURATE, INCOMPLETE, OR OUT OF DATE, Casino Comp Wallet DOES NOT INTENTIONALLY MAKE MATERIAL MISREPRESENTATIONS NOR DOES Casino Comp Wallet INTENTIONALLY PROVIDE INCORRECT INFORMATION.
- YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SITES OR THE SERVICES OR ANY CONTENT CONTAINED THEREIN OR DOWNLOADED THEREFROM IS AT YOUR OWN DISCRETION AND RISK AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL AND/OR DATA.
- Casino Comp Wallet SHALL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE CAUSED, OR ALLEGED TO HAVE BEEN CAUSED, DIRECTLY OR INDIRECTLY, BY THE INFORMATION OR IDEAS CONTAINED, SUGGESTED OR REFERENCED AT THE SITES, THROUGH THE SERVICES, OR ANY USE OF SAME BY YOU.
Indemnification
You agree to indemnify, hold harmless and release Casino Comp Wallet and its respective employees, directors, stakeholders, agents, licensors and their respective successors and assigns, from and against any and all claims, damages, costs and expenses, including reasonable attorney’s fees, arising from or related to Your use or misuse of the Sites, the Services and/or any content contained therein or provided thereby (including, but not limited to information from third-party websites linked to the Sites.
